Terms and Conditions of Service
|TERMS AND CONDITIONS OF SERVICE CONTRACT|
Legal Name: Destin Limo Service Inc., a for-profit Florida corporation, will hereinafter be referred as Destin Limo. Destin Limo will strictly enforce State and Federal Laws and will maintain a zero-tolerance compliance policy that no alcoholic beverages can be consumed or used by any person not of legal drinking age. All U.S. law enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard, even in negligible quantities without the chauffeur’s knowledge, they can seize and forfeit this vehicle to a local government agency. All law enforcement agencies are aggressively enforcing this policy. Therefore, no person will bring contraband aboard vehicles that are owned or operated by Destin Limo. Destin Limo will not be responsible for injuries that may occur due to horse playing while the vehicle is in motion or at a standstill. The purchaser on the front of this contract is responsible for his or her guests. AT THE CHAUFFEURS DISCRETION, THE PURCHASER AGREES TO BE FULLY LIABLE FOR ALL CHARGES THAT MAY INCUR.
(1) $ 20.00 Per broken glassware, $ 45.00 per damaged DVD,
(2) $ 15 per damaged towel, $ 50.00 per damaged pillow, $ 100.00 per damaged Bed-Sheet
(3) $ 100 minimum for extensive cleanup (spill, etc.)
(4) $ 250 detailing and wax ( due to sickness – exterior)
(5) $ 375 Shampoo and disinfecting ( due to sickness interior)
(6) $ 375 minimum for each burn hole, rip or tear to upholstery
(7) $ 1.500 minimum for each act of vandalism or intentional damage
(8) Triple charge of above listed amounts for all removed/stolen items from the vehicle
(9) Downtime subject to loss of revenue, per each hour lost as stated in invoiced services
Destin Limo recommends that any and all personal valuables be removed from the vehicle when unattended. We will not be held responsible for any lost, stolen, or damage articles. Destin Limo reserves the right to terminate this or any other contract for non-compliance of the above request, especially if renters do not follow chauffeurs’ requests in order to obey the rules in this contract. No smoking is allowed in our vehicles. Any deposits (cash, checks or credit card authorization) will be non-refundable for any reason, if any cancellation occurs from renter’s side. The open balance is due either 30 days prior to the service date, or immediately upon acceptance if within 30 days, or immediately at the beginning of the agreed job if paid in cash for a last-minute booking. The renter authorizes the immediate 50 % deposit & the final payment, states that he/she is the authorized purchaser for this rental contract, the authorized card holder for the given credit card, responsible and liable for payment of the total amount, per cash, credit card or money order. No personal or business checks will be accepted unless prior approval is received. As with all contracts, the rental contract between the mentioned person as renter and Destin Limo, is made with the information and the terms given to us. All of the given information from the renter is binding and cannot be changed without Destin Limo’s acceptance. If the contract is cancelled after it is signed, Destin Limo is still authorized to collect the remaining balance in full, if the car was not rented again on the cancelled date for the same or higher amount. We will reserve the said date upon the approval of the purchaser’s credit card as per telephone, text or email communications. The credit cardholder gives authorization to use the credit card information over the phone/fax/internet. Proof of identity of the purchaser using said credit card must be supported by the signed contract/ credit card authorization via fax, electronic means or in person. At the time of pick-up we need the credit card, state identification of the purchaser that authorizes the transaction for the signed contract. If the purchaser cannot provide all the above items at the time of pickup, Destin Limo reserves the right to not start the job, as we have no proof of the legal possession of the credit card. Therefore, the risk of not getting paid will give us the right to cancel your booking. The purchaser is still fully responsible to pay the total amount as he or she failed to provide the above requirements. Destin Limo cannot guarantee the availability of overtime. It is of particular importance that the purchaser makes allowances for anticipated delays and adheres to the agreed time schedule. In the event that the purchaser wants to change the time of the itinerary, they may do so, only if Destin Limo can accommodate other clients that booked with Destin Limo prior to or after the said time. The purchaser further agrees to pay additional charges incurred such as overtime, cellular usage, tolls, parking etc. Overtime for airport/seaport jobs is charged in 15 minutes increments along with extra stops that are charged a rate disclosed in your invoice per additional stop. If a customer fails to show at designated pick up location and does not inform the office and/or driver, the full amount contracted time will be charged. The purchaser authorizes Destin Limo to charge any additional charges after they have rendered services to the purchaser’s credit card as supplemental charge. A 20 % gratuity will be added to your total charge as well as a fuel or other surcharge if applicable and you have authorized said surcharge in your invoice. If cash payment is selected, the payment is due at the beginning of the rental time. Customer agrees to have Destin Limo get an authorization for the above credit card and amount, for the event stated above.
Any payment due hereunder will be unpaid (10) ten days after the due date, thereon Destin Limo will have the right to add and collect late charges with interest at maximum rate allowed by law. All such sums are due and owing with any others expenses, (filling fees, court cost, and reasonable attorney fees etc.). Necessarily injuries by reason of such non-payments, I, the credit card holder / purchaser, agree to pay Destin Limo upon signing of this contract. I am satisfied with the terms and conditions above and fully understand and agree. If, for any reasons, I am not fully satisfied with the service I receive, I have 24 hours after the completion of the job to file complaint in writing by sending an email to [email protected], and then sending a copy of said email notice by Certified U.S. Mail to 35 Cobia Ct, Santa Rosa Beach, FL 32450. If Destin Limo does not receive my written complaint in above stated time-frame, I agree that there is not a valid complaint and I am fully satisfied with the services I received and neither I, my guest(s) or others associated with me, will make, transmit or publish any derogatory or false statements about Destin Limo, it’s officers, employees or independent contractors, without such statements constituting libel per say. Filling a written complaint insures both parties, that it is fully understood what the problem was, and should help Destin Limo to assist the purchaser in any kind of reimbursement. Upon receipt of the Certified Mail delivered written complaint, the customer will be contacted within 30 days of the complaint to settle the matter. I understand that this is a separate matter from the main transportation rental contract and therefore have no dispute in general against Destin Limo and the payment I authorized, and therefore, disputing your authorized credit card charge is only allowed if Destin Limo failed to arrive at your requested pick-up location for your booked service. If any dispute cannot be resolve within 60 days after we receive your written complaint via certified mail, it shall be resolved by the process described below through Mediation and/or Arbitration. Since Destin Limo offers high-tech-equipped vehicles, sometimes heat and excessive use of all power-equipment might be subject to temporary failure. This will of course not interfere with the safety of the vehicle itself and therefore will have no effect on continuing or paying of the contracted trip. Further, I fully understand that if Destin Limo provides free, in-car computer internet access in some vehicles and that these free services are not guaranteed to be available & operational in all vehicles and all locations and are only offered as an additional service to our valued customers. Destin Limo guarantees, that all our vehicles are constantly checked to keep the highest possible standards and eliminate such failures as much as possible. Destin Limo agrees to send the requested vehicle as offered in the contract. We have the right to upgrade the vehicles or switch the vehicles in case of emergency breakdown, the requested vehicle has been sold or if vehicles were involved in accidents. As stated, this will only happen in an emergency, and to upgrade, never downgrade. If no upgrade is available, Destin Limo gives the customer the right to downsize the vehicle and receive additional discounts if wanted. No additional charges will occur on customer side if upgrade is made without customer request. If switching occurs in the same category, or upgrades are made, it will not affect the contract and / or payment of contract. A customer therefore accepts that a replacement limousine may be substituted if contracted limousine becomes unavailable for any reason.
Mediation and Arbitration. (A.) In the event a dispute arises out of or in connection with this Agreement, the Parties will attempt to resolve the dispute through friendly consultation as described above within 60 days after we receive your certified mail written complaint. (B.) If the dispute is not resolved within a reasonable period then any and all outstanding issues may be submitted to mediation with a mediator certified by the Florida Supreme Court and in accordance with Rule 10.100 of the Florida Rules for Certified and Court-Appointed Mediators. (C.) If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration in accordance with the laws of the State of Florida. The Parties agree to submit to the National Arbitration Forum. The Parties agree that the jurisdiction forum shall be Bay County, Florida and that this Agreement and all matters herein shall be controlled by the laws of the State of Florida and the Rules of the chosen body to govern the arbitration. The arbitrator’s award will be final, and judgment may be entered upon it by any court having jurisdiction within the State of Florida. The customer electing to resolve any dispute after an unsuccessful mandatory mediation, shall proceed to binding arbitration and shall bear all cost associated with with arbitration, including but not limited to: legal counsel, expert witnesses, administration fees, cost(s), ect., and if the customer fails to prevail in arbitration, customer shall be responsible for all costs Destin Limo has incurred to defend customer’s complaint, which includes but not limited to; legal expenses, expert witnesses, administration, employee, shareholder and/or executive compensation for all time spent on customer’s dispute claim, travel expenses, discovery compliance expenses and costs.
If any of above guarantees or contracted terms cannot be met due to conditions outside of our control, including weather, accidents and other acts of god, we will use our best efforts to notify the customer of these conditions and resulting delays or changes. The signee of this agreement promises and agrees to indemnify, assume the defense and hold harmless Destin Limo, it’s employees and officers from and against any and all claims resulting from the signee’s negligence or that of any third parties, as well as any and all claims resulting from acts of Destin Limo’s, it employees and officers negligence. By evidence of my signature below, I hereby declare and confirm that I have been given the opportunity to read, review and inquiry about each of the aforementioned contracted terms and conditions to my satisfaction and fully understand this agreement in its entirety and sign this agree freely of my own volition. Further, authorize the processing of my credit card payment by Destin Limo, Celebrity Realty International or any of Destin Limo’s affiliates, agents and/or subsidiaries, for limousine services contemplated and agreed to under this agreement.
ADDITIONAL TERMS AND CONDITIONS below amended May 28th 2020 at 1:12 PM CST Customer hereby authorizes DESTIN LIMO to process your credit card payment for the charges listed in your invoice sent electronically by email to the email address you’ve provided and you agree to pay said charges in full, and in accordance with the credit card issuers’ agreement. By computer or other electronic device, your clicking the “iAgree” box on our website and/or your “KEYED IN” entry of your credit card information to remit payment for your invoice from any electronic device, is done so by you voluntarily and submission of your payment for services described in your invoice, constitutes a WILLFUL submission of your Electronic Signature pursuit to the Florida Electronic Signature Act of 1996 and Florida’s Uniform Electronic Transfer Act and the 2000 federal ESIGN Act, whereas your approval and payment remittance of this invoice, and acknowledgment and acceptance of DESTIN LIMO’s TERMS AND CONDITIONS listed herein at https://destinlimoservice.com/terms_and_conditions_privacy_policy_for_destin_limo_service/ Pursuit to the Uniform Electronic Transaction Act (UETA), Florida Statutes § 668.50, an “Electronic signature” means any letters, characters, or symbols, manifested by electronic or similar means, executed or adopted by a party with an intent to authenticate a writing. A writing is electronically signed if an electronic signature is logically associated with such writing. Wherein, you hereby AGREE that your voluntary entry of your credit card number, expiration date, name on your credit card, CCV number, billing zip code, bank account routing number and/or bank account number, constitutes your WILLFUL “Electronic Signature” being constructively executed upon DESTIN LIMO’s TERMS AND CONDITIONS contract listed at https://destinlimoservice.com/terms_and_conditions_privacy_policy_for_destin_limo_service/, or if you provide your credit card or bank account information to us over the phone for us to process, you hereby agree that upon your voluntary electronic acceptance of your Google Calendar notification of your rental booking will be associated with this contract by your willful physical clicking on the electronic symbol, “ACCEPT” button, in your calendar notification, or upon your submission of an online quote request from our website and your clicking on the electronic check-box “iAgree”.
